A serious issue concerning the professional conduct of Atul Ahire, President of the Maharashtra State Pharmacy Council, has taken a significant turn, with the Pharmacy Council of India (PCI) taking cognizance of a complaint against him and forwarding it to the Maharashtra State Pharmacy Council for “necessary action.”
The complaint was filed by Dr. Vedprakash Tiwari, Advocate Bombay High Court, seeking an independent inquiry and disciplinary action in connection with alleged professional misconduct and conflict of interest involving Mr. Ahire.
PCI’s Clear Direction: “Necessary Action under Intimation to PCI”
In its communication bearing Ref. No. 12-9/2026-PCI, the Pharmacy Council of India has specifically referred to letters dated 04/04/2026 and 09/04/2026 submitted by Dr. Tiwari.
The PCI forwarded the said communications to the Registrar, Maharashtra State Pharmacy Council, stating that the matter was self-explanatory and required necessary action.
Significantly, the PCI communication concludes: “This is for necessary action under intimation to PCI.”
The communication therefore makes it clear that the matter has been placed before the MSPC for appropriate action and that the PCI is to be kept informed of the action taken.
FDA Action Also Cited in the Complaint
Dr. Tiwari’s complaint had referred to regulatory action taken by the Food and Drug Administration (FDA), Maharashtra, against medical stores allegedly directly connected with Mr. Atul Ahire.
The establishments mentioned include Universal Medical, Thane West; Raksha Healthcare, Goregaon West; and Vedant Chemist, Goregaon.
According to the complaint, regulatory action including suspension and cancellation of drug licences had been taken against these establishments. In view of these developments, the complaint sought an independent examination of Mr. Ahire’s professional conduct and his role in the concerned establishments.
Questions Over Regulatory Integrity
The fact that a complaint concerning professional misconduct and conflict of interest has been raised against the President of the State Pharmacy Council has raised serious questions regarding the transparency and credibility of the regulatory mechanism.
The crucial issue now is whether the MSPC will ensure an independent, impartial and transparent examination of the complaint, particularly when the complaint concerns its own President.
Dr. Vedprakash Tiwari, Advocate, Bombay High Court, who is pursuing the matter, said: “This is not merely a complaint against an individual; it concerns the ethical standards of the pharmacy profession and the credibility of regulatory institutions. The PCI has forwarded the complaint to the MSPC for necessary action. The matter must now be dealt with independently, transparently and within a reasonable time. No office or position should place anyone above the rules.”
Now, What Action Will MSPC Take?
After the PCI forwarded the complaint to the MSPC for “necessary action”, all eyes are now on the Maharashtra State Pharmacy Council.
Who will conduct the inquiry, how will the alleged conflict of interest be addressed, and when will the action taken be communicated to the PCI? These questions are now at the centre of the controversy.
